Overview
The detailed involvement in these types of cases has provided him the ability to quickly evaluate cases from a multitude of varying perspectives in order to advise his clients on the options available to them early on and throughout the litigation process. He recognizes that communication and understanding are key matters which must involve his clients in order to evaluate the cases on an individual basis. Ken’s primary practice areas encompass civil litigation in industries including oil and gas, trucking, cargo, premises liability, personal injury, first- and third- party, commercial, products liability, construction, insurance policy interpretation, additional insured analysis, contracts, indemnity, and appeals.
Representative Matters
Ken prides himself in his ability to present matters to the court, and throughout his career, he has been very successful in obtaining favorable rulings on numerous motions which directly affect the outcome of the case. These include motions for summary judgment, motions to strike experts, motions to exclude evidence, declaration actions regarding insurance coverage, and the appeals seeking to uphold such rulings.
- Trucking cases involving accidents, deaths, and coverage. Apartment and premises liability cases following shootings, assaults, and injuries on the premises. Dealership responsibility during the sales of RVs and automobiles.
- Following an incident in which a company accidentally damaged a pipeline from the Strategic Petroleum Reserve, the case involved recovery of the expenses paid to repair the pipeline. The issues included additional insured status, contractual interpretation, government regulations, and the coverage provided by a very unique London manuscript insurance policy. After prevailing at trial, the judge took away the verdict, and upon appeal to the Fifth Circuit, the Judgment was reinstated.
- When an upset in the refinery led to a product that damaged another plant, an intensive investigation and analysis into plant operations surrounded the lawsuit involving additional insured issues, chemical reactions, and extensive plant damages.
- After an explosion at a refinery resulted in a death, the case involved a thorough evaluation of the plant operations and the ultimate cause of the incident.
- Multiple cases involving oil field operations, and tragic incidents on site which caused property damages, and extraordinary injuries and deaths.
